Prior to codification, employers and employees grappled with numerous and often outdated legislations, differing across States and sectors. This complexity created compliance difficulties for businesses and left many workers\u2014especially in the unorganised sector\u2014without adequate social security or basic protections.<\/p>\n<p data-start=\"1728\" data-end=\"2201\">Recognising these challenges, the Government of India undertook a historic reform by consolidating <strong data-start=\"1827\" data-end=\"1883\">29 central labour laws into four comprehensive codes<\/strong>. The objective was to simplify compliance, enhance coverage, and ensure that all workers\u2014irrespective of employment status or income\u2014receive minimum statutory protection. Notably, the inclusion of <strong data-start=\"2081\" data-end=\"2150\">gig workers, platform workers, and modern employment arrangements<\/strong> reflects the evolving nature of the labour market.<\/p>\n<p data-start=\"2203\" data-end=\"2229\">The four labour codes are:<\/p>\n<ol data-start=\"2231\" data-end=\"2755\">\n<li data-start=\"2231\" data-end=\"2314\">\n<p data-start=\"2234\" data-end=\"2314\"><strong data-start=\"2234\" data-end=\"2261\">The Code on Wages, 2019<\/strong> \u2013 consolidates laws relating to wages and bonuses.<\/p>\n<\/li>\n<li data-start=\"2315\" data-end=\"2451\">\n<p data-start=\"2318\" data-end=\"2451\"><strong data-start=\"2318\" data-end=\"2357\">The Industrial Relations Code, 2020<\/strong> \u2013 consolidates laws governing trade unions, employment conditions, and industrial disputes.<\/p>\n<\/li>\n<li data-start=\"2452\" data-end=\"2601\">\n<p data-start=\"2455\" data-end=\"2601\"><strong data-start=\"2455\" data-end=\"2492\">The Code on Social Security, 2020<\/strong> \u2013 consolidates laws relating to social security and extends coverage to organised and unorganised sectors.<\/p>\n<\/li>\n<li data-start=\"2602\" data-end=\"2755\">\n<p data-start=\"2605\" data-end=\"2755\"><strong data-start=\"2605\" data-end=\"2674\">The Occupational Safety, Health and Working Conditions Code, 2020<\/strong> \u2013 consolidates laws regulating workplace safety, health, and working conditions.<\/p>\n<\/li>\n<\/ol>\n<h2 data-start=\"2762\" data-end=\"2802\"><strong data-start=\"2765\" data-end=\"2802\">EVOLUTION OF LABOUR LAWS IN INDIA<\/strong><\/h2>\n<p data-start=\"2804\" data-end=\"3135\">During the 18th century, India was a major agricultural and manufacturing economy, particularly in textiles. British colonial policies, however, discouraged indigenous manufacturing to promote British industries. Heavy export duties on Indian goods and duty-free imports of British products led to the decline of local handicrafts.<\/p>\n<p data-start=\"3137\" data-end=\"3576\">With industrial growth came exploitation of cheap labour. The plantation industry in Assam was among the first to attract legislative intervention due to restrictions imposed on workers\u2019 freedom. Early legislations such as the <strong data-start=\"3364\" data-end=\"3389\">Apprentices Act, 1850<\/strong>, <strong data-start=\"3391\" data-end=\"3414\">Factories Act, 1881<\/strong>, and <strong data-start=\"3420\" data-end=\"3439\">Mines Act, 1901<\/strong> largely protected employer interests. A notable exception was the <strong data-start=\"3506\" data-end=\"3542\">Workmen\u2019s Compensation Act, 1923<\/strong>, which focused on worker welfare.<\/p>\n<p data-start=\"3578\" data-end=\"3702\">Post-independence, India enacted several labour laws to regulate labour-management relations and promote welfare, including:<\/p>\n<ul data-start=\"3703\" data-end=\"3947\">\n<li data-start=\"3703\" data-end=\"3738\">\n<p data-start=\"3705\" data-end=\"3738\"><strong data-start=\"3705\" data-end=\"3738\">Industrial Disputes Act, 1947<\/strong><\/p>\n<\/li>\n<li data-start=\"3739\" data-end=\"3781\">\n<p data-start=\"3741\" data-end=\"3781\"><strong data-start=\"3741\" data-end=\"3781\">Employees\u2019 State Insurance Act, 1948<\/strong><\/p>\n<\/li>\n<li data-start=\"3782\" data-end=\"3824\">\n<p data-start=\"3784\" data-end=\"3824\"><strong data-start=\"3784\" data-end=\"3824\">Employees\u2019 Provident Funds Act, 1952<\/strong><\/p>\n<\/li>\n<li data-start=\"3825\" data-end=\"3858\">\n<p data-start=\"3827\" data-end=\"3858\"><strong data-start=\"3827\" data-end=\"3858\">Maternity Benefit Act, 1961<\/strong><\/p>\n<\/li>\n<li data-start=\"3859\" data-end=\"3884\">\n<p data-start=\"3861\" data-end=\"3884\"><strong data-start=\"3861\" data-end=\"3884\">Factories Act, 1948<\/strong><\/p>\n<\/li>\n<li data-start=\"3885\" data-end=\"3914\">\n<p data-start=\"3887\" data-end=\"3914\"><strong data-start=\"3887\" data-end=\"3914\">Minimum Wages Act, 1948<\/strong><\/p>\n<\/li>\n<li data-start=\"3915\" data-end=\"3947\">\n<p data-start=\"3917\" data-end=\"3947\"><strong data-start=\"3917\" data-end=\"3947\">Payment of Bonus Act, 1965<\/strong><\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"3954\" data-end=\"3994\"><strong data-start=\"3957\" data-end=\"3994\">NEED FOR CONSOLIDATION AND REFORM<\/strong><\/h2>\n<p data-start=\"3996\" data-end=\"4211\">By the early 21st century, India\u2019s labour legislation had become fragmented, comprising over <strong data-start=\"4089\" data-end=\"4137\">20 central laws and more than 100 State laws<\/strong>. This multiplicity created compliance difficulties and legal uncertainty.<\/p>\n<p data-start=\"4213\" data-end=\"4383\">The <strong data-start=\"4217\" data-end=\"4264\">Second National Commission on Labour (2002)<\/strong> recommended consolidating labour laws into simplified codes. Acting on this recommendation, the Government introduced:<\/p>\n<ul data-start=\"4384\" data-end=\"4556\">\n<li data-start=\"4384\" data-end=\"4449\">\n<p data-start=\"4386\" data-end=\"4449\">The <strong data-start=\"4390\" data-end=\"4412\">Code on Wages Bill<\/strong> in July 2019, passed in August 2019.<\/p>\n<\/li>\n<li data-start=\"4450\" data-end=\"4556\">\n<p data-start=\"4452\" data-end=\"4556\">The remaining three Bills in September 2020, all of which were passed in the same parliamentary session.<\/p>\n<\/li>\n<\/ul>\n<h2 data-start=\"4563\" data-end=\"4606\"><strong data-start=\"4566\" data-end=\"4606\">MAJOR REFORMS UNDER THE LABOUR CODES<\/strong><\/h2>\n<h3 data-start=\"4608\" data-end=\"4638\"><strong data-start=\"4612\" data-end=\"4638\">1.
