The wages and\u00a0 welfare of seafarers form an essential part of maritime labour standards. Under\u00a0 both international and national maritime laws, the shipowner bears the primary\u00a0 responsibility to guarantee fair wages, humane working conditions, medical\u00a0 care, and welfare facilities for all crew members.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Maritime Labour Convention (MLC), 2006, often referred to as the\u00a0 \u201cSeafarers\u2019 Bill of Rights,\u201d is the cornerstone international instrument that\u00a0 consolidates and modernizes these standards. It ensures that seafarers have the\u00a0 same basic rights as workers ashore, including fair pay, regular wage payment,\u00a0 medical care, repatriation rights, social protection, and welfare facilities both on\u00a0 board and ashore.\u00a0<\/span><\/p>\n<p><b>Wages of Seafarers<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Wages refer to the monetary compensation paid by the shipowner to the seafarer\u00a0 for services rendered on board a ship. It includes not only the basic pay but also\u00a0 allowances, overtime, and other benefits as specified in the seafarers\u2019\u00a0 employment agreement or as prescribed by law or collective agreements.\u00a0<\/span><\/p>\n<p><b>Maritime Labour Convention<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The International Labour Organization (ILO) addresses seafarers\u2019 wages\u00a0 through several conventions, including the Maritime Labour Convention (MLC)\u00a0 and the Joint Maritime Commission (JMC). For the first time, the MLC\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">consolidates in one place the minimum requirements for the treatment of\u00a0 seafarers. The MLC incorporates and builds on 68 existing maritime labour\u00a0 conventions and recommendations, as well as other fundamental principles, to\u00a0 ensure decent working and living conditions for all seafarers.\u00a0<\/span><\/p>\n<p><b>Seafarers\u2019 Rights<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The MLC details the obligations of governments and shipowners under four\u00a0 main headings:\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u27a2 <\/span><span style=\"font-weight: 400;\">Minimum requirements for seafarers to work on a ship.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u27a2 <\/span><span style=\"font-weight: 400;\">Conditions of employment.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u27a2 <\/span><span style=\"font-weight: 400;\">Accommodation, recreational facilities, food, and catering. <\/span><span style=\"font-weight: 400;\">\u27a2 <\/span><span style=\"font-weight: 400;\">Health protection, medical care, welfare, and social security protection.\u00a0<\/span><\/p>\n<p><b>MLC 2006 Regulation 2.2 \u2013 Seafarer Wage Requirements<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Regular and full payment of wages, along with detailed accounting to the\u00a0 seafarer, is a major obligation of the shipowner.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Main provisions related to wages under the MLC :\u00a0\u00a0<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Right to regular and full payment.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Seafarers must be paid their wages at least once a month in full. Payment\u00a0 must be made in legal tender or through bank transfer as agreed in the\u00a0 seafarers\u2019 employment agreement.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Employers cannot delay or withhold wages without a valid reason. This\u00a0 prevents shipowners from holding back wages while seafarers are at sea\u00a0 for long durations.<\/span><\/li>\n<\/ol>\n<p><strong>Accommodation and Food\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">The MLC sets international standards for accommodation, recreational\u00a0 facilities, food, and catering on ships to promote seafarers\u2019 health and well being.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regulation 3.1 \u2013 Accommodation and Recreational Facilities:\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ensures seafarers have decent accommodation and recreational facilities on\u00a0 board.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regulation 3.2 \u2013 Food and Catering:\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ensures seafarers have access to high-quality food and drinking water under\u00a0 regulated hygienic conditions.\u00a0<\/span><\/p>\n<p><b>Key provisions:\u00a0<\/b><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Quality and provision of food: Ships must carry and serve food and\u00a0 drinking water of suitable quality, nutritional value, and quantity. All\u00a0 meals must be provided free of charge during the period of employment.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Training and qualification: Seafarers employed as ship cooks must be\u00a0 trained, qualified, and competent for their position.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The MLC also includes practical training on cookery, food hygiene, storage,\u00a0 stock control, catering safety, and environmental protection.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Health Protection and Medical Care<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regulation 4.1 \u2013 Medical Care Onboard and Ashore:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ensures seafarers enjoy proper health protection and prompt access to medical\u00a0 care both on board and ashore.\u00a0<\/span><\/p>\n<p><b>Key provisions:\u00a0<\/b><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Each Member State must ensure that all seafarers on ships flying its flag\u00a0 are provided with adequate health protection and medical care while\u00a0 working on board.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Medical care and protection must be available free of charge to the\u00a0 seafarers.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Seafarers requiring immediate medical attention while in port must be\u00a0 given access to shore-based medical facilities of that Member State.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Medical care provided to seafarers should be as comparable as possible to\u00a0 that available to workers on land.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">This regulation guarantees that seafarers receive medical care comparable to\u00a0 that available to shore-based workers, ensuring free, prompt, and adequate\u00a0 healthcare both at sea and in port.\u00a0<\/span><\/p>\n<p><b>Wages and Welfare Protections<\/b><b>\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The wages and welfare of seamen represent a vital aspect of maritime labour\u00a0 law , ensuring that those who dedicate their lives to service at sea are protected\u00a0 , respected , and adequately compensated. Seafarers face unique challenges\u00a0 such as isolation, harsh working conditions, and long periods away from home.\u00a0\u00a0<\/span><\/p>\n<p><strong>The MLC ensures:<\/strong><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Wages are paid in legal tender or via bank transfer, cheque, or money\u00a0 order.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Wages are paid without undue delay upon termination of service. 3. Penalties apply to shipowners who delay or fail to pay wages.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\"> Wages are paid directly into the seafarer\u2019s designated bank account\u00a0 unless otherwise requested.\u00a0<\/span><\/li>\n<\/ol>\n<p><b>Conclusion\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Seafaring is one of the most perilous occupations in the world. Seafarers face\u00a0 risks such as accidents, illness, and loss of life due to the nature of their work\u00a0 and environment. International and national legislation, including the MLC\u00a0 2006, imposes obligations on shipowners to safeguard seafarers\u2019 welfare,\u00a0 provide medical assistance, and ensure compensation in cases of injury or death.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">MLC Guidelines B4.1.1 ensure the provision of medical care at sea, even in the\u00a0 absence of a shipboard doctor. Ships capable of reaching medical facilities\u00a0 within 8 hours must have at least one seafarer trained in advanced medical care,\u00a0 including life-saving techniques such as intravenous therapy.
