Chapter IX of the Bharatiya Nyaya Sanhita, 2023 deals with <\/span>electoral offences<\/b>, which\u00a0 are crucial for maintaining the integrity and fairness of the democratic process in India.\u00a0 This chapter outlines specific actions that are considered illegal during the conduct of\u00a0 elections, such as <\/span>bribery, undue influence, personation, false statements<\/b>, and <\/span>breach\u00a0 of voting secrecy<\/b>.\u00a0\u00a0<\/span><\/p>\n

The purpose of these provisions is to prevent <\/span>corrupt practices <\/b>and ensure that elections\u00a0 are conducted in a <\/span>free, fair, and transparent <\/b>manner. By criminalizing dishonest\u00a0 tactics and manipulation of voters, this chapter plays a vital role in upholding <\/span>electoral\u00a0 justice <\/b>and the <\/span>democratic values <\/b>enshrined in the Constitution.\u00a0\u00a0<\/span><\/p>\n

It covers Sections <\/span>169 to 177, <\/b>prescribing punishments for each offence to deter\u00a0 individuals and political entities from undermining the electoral process.\u00a0\u00a0<\/span><\/p>\n

Section 169 \u2013 Bribery.\u00a0<\/b><\/p>\n

Offering or accepting gratification (money, gift, etc.) to induce a person to vote or not to vote, or\u00a0 to influence their candidature.\u00a0\u00a0<\/span><\/p>\n

Essentials:\u00a0\u00a0<\/b><\/p>\n

– <\/span>Accepting or offering gratification as a motive for:\u00a0\u00a0<\/span><\/p>\n

– <\/span>Voting or refraining from voting.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Standing or refraining from standing as a candidate.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Inducing someone else to vote or not vote.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Inducing a person to stand or not stand as a candidate.\u00a0\u00a0<\/span><\/p>\n

Punishment: Imprisonment up to 1 year or fine, or both.\u00a0\u00a0<\/span><\/p>\n

Explanation: A declaration of public policy or promise of public action is not considered\u00a0 bribery.\u00a0\u00a0<\/span><\/p>\n

Example: Distributing cash to villagers before elections to vote in favor of a candidate.\u00a0\u00a0<\/span><\/p>\n

Section 170 \u2013 Undue Influence at Elections.\u00a0<\/b><\/p>\n

Using force, threat, or spiritual or psychological pressure to influence a voter\u2019s choice.\u00a0 <\/span>Essentials<\/b>:\u00a0<\/span><\/p>\n

– <\/span>Interference with free exercise of electoral rights.\u00a0\u00a0<\/span><\/p>\n

Punishment: Imprisonment up to 1 year or fine, or both.\u00a0\u00a0<\/span><\/p>\n

Illustration: A priest threatens followers with excommunication if they vote for a certain\u00a0 candidate.\u00a0\u00a0<\/span><\/p>\n

Section 171 \u2013 Personation at Elections.\u00a0<\/b><\/p>\n

Voting or attempting to vote in someone else’s name or more than once.\u00a0\u00a0<\/span><\/p>\n

Essentials<\/b>:\u00a0\u00a0<\/span><\/p>\n

– <\/span>Voting as another person (dead, living, or fictitious).\u00a0\u00a0<\/span><\/p>\n

– <\/span>Voting more than once.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Allowing or procuring such voting.\u00a0\u00a0<\/span><\/p>\n

Punishment: Imprisonment up to 1 year or fine, or both.\u00a0\u00a0<\/span><\/p>\n

Note: The section also applies to voting through postal ballots or electronic means.\u00a0\u00a0<\/span><\/p>\n

Section 172 \u2013 False Statement in Connection with Elections. <\/b>Publishing or circulating false statements about a candidate\u2019s character or conduct<\/span>.\u00a0\u00a0<\/span><\/p>\n

Essentials<\/b>:\u00a0\u00a0<\/span><\/p>\n

– <\/span>Intent to affect the outcome of an election.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Publishing a false statement regarding personal character or conduct.\u00a0 Punishment: Imprisonment up to 6 months or fine, or both.\u00a0\u00a0<\/span><\/p>\n

Case Law: R. Shankarappa v. Election Commission of India \u2013 Malicious defamatory\u00a0 statements made during campaigns may lead to disqualification<\/span>.\u00a0\u00a0<\/span><\/p>\n

Section 173 \u2013 Illegal Payments in Connection with Elections.\u00a0<\/b><\/p>\n

Expenses not authorized by the candidate\u2019s election agent, including public meetings or\u00a0 advertisements<\/span>.\u00a0\u00a0<\/span><\/p>\n

Section 174 \u2013 Failure to Keep Election Accounts. <\/b>Not maintaining a record of expenses as required by election laws<\/span>.\u00a0\u00a0<\/span><\/p>\n

Section 175 \u2013 Maintenance of Secrecy of Voting. <\/b>Disclosing or attempting to know for whom someone has voted<\/span>.\u00a0\u00a0<\/span><\/p>\n

– <\/span>Breach of the secrecy of the ballot by an election officer or polling agent.\u00a0 <\/span>– <\/span>Use of information regarding voting preference for any gain.\u00a0\u00a0<\/span><\/p>\n

Punishment: Imprisonment up to 3 months or fine, or both<\/span>.\u00a0\u00a0<\/span><\/p>\n

Section 176 <\/b>\u2013 <\/span>Illegal Payments in Connection with an Election. <\/b>This section deals with unauthorized election expenditure on behalf of a candidate.\u00a0\u00a0<\/span><\/p>\n

It aims to prevent unregulated election campaigning and bribery disguised as public\u00a0 influence efforts<\/span>.\u00a0\u00a0<\/span><\/p>\n
