As the senior\u00a0 citizen population is growing, we are also seeing greater numbers of neglect and\u00a0 abuse, signifying further need for a legal mechanism as a solution. This Act put in\u00a0 place a framework to provide a systematic process to ensure that a senior citizen is\u00a0 provided maintenance and care by children or heirs, and the Act provides some\u00a0 remediation in the situation that the heirs are neglectful.<\/span><\/p>\n<p><b>Maintenance and Financial Security:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act provides for financial support of elderly parents and dependent relatives\u00a0 from their children or legal heirs so that they can live with dignity and security.\u00a0 <\/span><\/p>\n<p><b>1. Avoidance of Neglect and Abuse:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">It safeguards elderly citizens from physical, psychological or monetary injury\u00a0 and prevents them from being abused by their family members or care providers.<\/span><\/p>\n<p><b>2. Legal Assistance to Elderly Parents:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act provides easy and affordable legal process for elderly parents to get\u00a0 maintenance so they don\u2019t have to struggle for their needs.\u00a0 <\/span><\/p>\n<p><b>3. Safeguarding Property Rights:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">If a senior citizen has given away their property with promise of care and support\u00a0 but is abandoned later the Act allows them to recover their property.\u00a0 <\/span><\/p>\n<p><b>4. Providing Safe Spaces through Old Age Homes and Healthcare\u00a0 Facilities:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">State governments have to establish and maintain old age homes in all districts so\u00a0 that the elderly without support from family have a place to live with care and\u00a0 dignity. <\/span><\/p>\n<p><b>5.Promoting Family Obligation:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act upholds the notion that the care of elderly parents is not only a statutory\u00a0 obligation but also a moral and social obligation and promotes a culture of respect\u00a0 and care within families.<\/span><\/p>\n<p><b>ANALYSIS :<\/b><b><\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Maintenance and Welfare of Parents and Senior Citizens Act, 2007 provides\u00a0 protection and support to our senior citizens and parents. Its primary goal is to\u00a0 ensure their welfare, legally obligate their children and grandchildren to provide\u00a0 maintenance and support. The Act provides means of addressing cases of neglect\u00a0 and abuse.\u00a0<\/span><\/p>\n<p><b>KEY PROVISIONS OF THE ACT :<\/b><b><\/b><\/p>\n<p><span style=\"font-weight: 400;\">This Act says that children or relatives who can afford should support senior\u00a0 citizens or parents who can\u2019t take care of themselves. Maintenance includes\u00a0 food, clothing, a place to live and medical care. Senior citizens in distress can\u00a0 ask for financial help from their children or legal heirs.\u00a0<\/span><\/p>\n<p><b>Tribunals for Maintenance Disputes:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act sets up Maintenance Tribunals at district level to deal with cases of\u00a0 parents and senior citizens. These Tribunals can order monthly maintenance\u00a0 and the state governments will fix the amount. They will also ensure that the\u00a0 cases are disposed off within 90 days so that senior citizens get a quick legal\u00a0 solution.\u00a0\u00a0<\/span><\/p>\n<p><b>Revocation of Property Transfer:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">If a senior citizen has given property to a relative on condition that they will\u00a0 take care of them and the relative doesn\u2019t do so, the property transfer can be\u00a0 cancelled. This rule will protect senior citizens from being pressurised to give\u00a0 away their assets.\u00a0<\/span><\/p>\n<p><b>Protection Against Abuse and Neglect:\u00a0<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act is very strict against those who abandon or neglect their elderly\u00a0 parents. It will ensure that older individuals are protected from financial,\u00a0 emotional and physical abuse. Anyone who abandons a senior citizen can be\u00a0 sent to jail or fined, so family members will be accountable.\u00a0<\/span><\/p>\n<p><b>Old Age Homes:<\/b><b><\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Act directs state governments to set up old age homes in every district to\u00a0 take care of and shelter needy senior citizens. These homes should have\u00a0 facilities for medical care, recreation and daily living needs.<\/span><\/p>\n<p><b>CASE LAWS UNDER THE ACT : <\/b><\/p>\n<ol>\n<li><b>Rajesh Kumar Srivastava v. State of UP &amp; Others (2017)\u00a0<\/b><\/li>\n<\/ol>\n<p><b>Facts: <\/b><span style=\"font-weight: 400;\">An elderly person filed a complaint against his son stating he received no\u00a0 care and support. The son argued he lacked the means to provide for his father.\u00a0<\/span><\/p>\n<p><b>Judgment<\/b><b>: <\/b><span style=\"font-weight: 400;\">The Allahabad High Court ruled that children must support their\u00a0 parents regardless of their economic status. The Maintenance Tribunal ordered the\u00a0 son to pay his father a fixed sum each month.\u00a0<\/span><\/p>\n<p><b>Significance<\/b><b>: <\/b><span style=\"font-weight: 400;\">This ruling highlighted children\u2019s legal duty to look after their\u00a0 elderly parents.\u00a0<\/span><\/p>\n<ol start=\"2\">\n<li><b> Justice Shanti Sarup Dewan v. Union Territory, Chandigarh\u00a0 (2014)\u00a0<\/b><\/li>\n<\/ol>\n<p><b>Facts: <\/b><span style=\"font-weight: 400;\">An 82-year-old former judge took action by submitting a petition to\u00a0 remove his son and daughter-in-law from his house citing ill-treatment as the\u00a0 cause.\u00a0<\/span><\/p>\n<p><b>Judgment: <\/b><span style=\"font-weight: 400;\">The Punjab &amp; Haryana High Court upheld the rights of older\u00a0 citizens stating that parents have the power to expel abusive children from their\u00a0 property.\u00a0<\/span><\/p>\n<p><b>Significance: <\/b><span style=\"font-weight: 400;\">This legal decision established a new standard. It demonstrated\u00a0 that older parents have the right to evict their abusive children from their homes.\u00a0 This holds true even when there\u2019s no formal agreement in place for the children to\u00a0 support their parents.<\/span><\/p>\n<ol start=\"3\">\n<li><b> Sunny Paul &amp; Another v. State NCT of Delhi (2017)\u00a0<\/b><\/li>\n<\/ol>\n<p><b>Facts: <\/b><span style=\"font-weight: 400;\">An elderly couple wished to evict their son and daughter-in-law from\u00a0 their residence. They had been victims of harassment, and the younger couple\u00a0 refused to vacate the house despite being asked to do so.\u00a0<\/span><\/p>\n<p><b>Judgment: <\/b><span style=\"font-weight: 400;\">The High Court stated that parents were also entitled to demand that\u00a0 their children vacate their house under the Act, regardless of the title to the\u00a0 property.\u00a0<\/span><\/p>\n<p><b>Significance: <\/b><span style=\"font-weight: 400;\">The decision reaffirmed and strengthened older adults\u2019\u00a0 entitlement to evict. It helped older adults to more easily terminate ongoing\u00a0 relationships with family members who were abusive.\u00a0<\/span><\/p>\n<ol start=\"4\">\n<li><b> S. Vanitha v. Deputy Commissioner, Bangalore Urban District\u00a0 (2020)\u00a0<\/b><\/li>\n<\/ol>\n<p><b>Facts<\/b><b>: <\/b><span style=\"font-weight: 400;\">An older man transferred the title of his property to his son. He received\u00a0 an assurance and agreement from the son that he would take care of him as his\u00a0 father aged and became incapacitated. After some time, the son stopped taking\u00a0 care of his father, creating a legal dispute about the property.\u00a0\u00a0<\/span><\/p>\n<p><b>Judgment: <\/b><span style=\"font-weight: 400;\">The Supreme Court recognized and ruled that older parents could\u00a0 recover elderly property transferred to the son by way of a care agreement, given\u00a0 the son\u2019s failure to honourable the care contract.\u00a0<\/span><\/p>\n<p><b>Significance: <\/b><span style=\"font-weight: 400;\">The decision added protections for older adults that place\u00a0 limitations on the abuse of property rights.<\/span><\/p>\n<ol start=\"7\">\n<li><b> <\/b><b>Conclusion:-<\/b><b><\/b><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">The Maintenance for Parents and Senior Citizens Act, 2007 has been very\u00a0 important in protecting and promoting the rights and dignity of senior citizens.\u00a0 Legal provisions for the maintenance of parents and senior citizens, and the added\u00a0 element of protection through legal remedies represent a significant step in\u00a0 legislative protection of older persons from neglect and abuse. Nevertheless, there\u00a0 continues, nonetheless, to be challenges to its implementation mainly, related to\u00a0 awareness about the law generally, and also, challenges to implementation. If the\u00a0 desires of this law are to be realized, awareness needs to be raised, access to legal\u00a0 representation and remedies increased, and safe and dignified places for our senior\u00a0 citizens created, all of which will require a concerted effort from government,\u00a0 society and legal infrastructure<\/span><b>.\u00a0<\/b><\/p>\n<p><b>Suggestions <\/b><b><\/b><\/p>\n<p><b>1.Implementation Constraints \u2013 <\/b><span style=\"font-weight: 400;\">What do you regard as the key\u00a0 obstacles to effective implementation of the law?\u00a0<\/span><\/p>\n<p><b>2<\/b><b>. Awareness initiatives \u2013 <\/b><span style=\"font-weight: 400;\">What suggestions do you have for getting the\u00a0 word out about the law to older persons and their family members? <\/span><b> <\/b><b>Changes in the law \u2013 <\/b><span style=\"font-weight: 400;\">Should the law be amended to better protect older\u00a0 persons?\u00a0<\/span><\/p>\n<p><b>3<\/b><b>.
