People use cellphones, smart watches, smart TVs, e-books, and even more advanced technology without any inconvenience. Everyone has access to new technology, but when we come to awareness of cybercrimes, frauds, hacking and suddenly you’ll find fewer people who are aware of it. Exactly this carelessness of not understanding the disadvantages of the devices we are using has increased the number of people getting defrauded in India.

It merely sounds simple, but when you find the exact number of people getting defrauded is unprecedented. India is on 10th number all over world for frauds and cybercrimes but now it is emerging as on 2nd place for getting defrauded. There is a 92.4% increase in numbers of cybercrimes from 2021 to 2024. Cases in India are increasing day by day which needs a serious recognition.

Most of the laws for cyber tech in India were formed at the time of 2000s when we didn’t have any advanced devices and developed devices. Do you think these old, formed laws can compete with current advanced working on the tech world? We can use old laws on normal cases but many of the cybercrimes in India are still pending without any perfect explanation. The number of cases pending formal legal justice is very high in almost ten thousand cases in each state. There is no particular law for cybercrimes in India instead there are 6 core frameworks over which cases are filed and they are BHARATIYA NYAYA SANHITA (BNS) 2023, THE NFROMATION TECHNOLOGY (IT)ACT 2000, BHARATIYA NAGRIK SURAKSHA SANHITA (BNSS) 2023, THE BHARATIYA SURAKSHA ADHINIYAM (BSA) 2023, THE DIGITAL PERSONAL DATA

PROTECTION 2023, THE TELECOMMUNICATION ACT 2023 and other subordinary laws like IT rules, CERT- In Cyber Security Directions, and Sector- Specific Regulation. Even after having these rules pillars, we are backward in getting protected from these crimes increasing due to the increase of developed instruments of technology. Few cases got practical justice were Shreya Singhal v. Union of India where Supreme Court struck down Section66A of IT act by which police was able to capture those people for uploading offensive posts on internet, SMC Pneumatics (India) Pvt. Ltd. v. Jogesh Kwatra in which court used digital IP tracking to catch the employee who posted private data of company to defame it, Sony Sambandh Case. But many cases are there too which didn’t get practical justice and were solved without any explanation like The AIIMS Delhi Ransomware Attack, Jamtara & Mewat Phishing Clusters.

This has become a vast problem for the people who are not informed about scams, frauds, even in current times. A higher number of people in India are not informed about how to save themselves from such crimes if they occur. The Ministry Electronics and Information Technology has enacted new laws for recent advanced technology, which is IT Rules Amendment Act 2026, which came in effect from 20 February 2026 to regulate the content created by the artificial intelligence and to remove unlawful content from internet created by the AI. India has enacted many laws for the regulation and lawful conduct of internet from 2000 till now, then why still India is emerging on 2nd place in world for cyber fraud and crimes? Are the rules not effective enough? Or is ministry not able to apply them properly? Well laws made by government are made with very need of current technology but the problem arises in many places like in India we do not have many number of tech cells, lack of regulation of digital content, the lack of clarity in cyber laws which is a very big loophole for such crimes, lack of enforcement of the laws in a proper manner. The Internet is accessed not only by adults, but most of them are kids who are exposed to certain vulnerabilities, and it has directly affected the new generation. Due to these loopholes in Indian technology laws, protection of privacy and mental health of kids is highly at risk because kids do have very sensitive brain at this age and if they are exposed to certain contents which are gore, illegal and sexual it can lead to disruption with their hypersensitive learning age. If you observe some families, they give their kids cellphones to do their work without any disturbance instead of telling their kids to do something productive. And when they are exposed to cellphone at early age which leads to slow development of their understanding of practical life, low communication skills, less understanding of theoretical education, less interest in learning something other than watching cartoons and random stuff. It’s going to be a very big issue in the upcoming future. It doesn’t mean that they shouldn’t be taught about advanced technology, but they need a limited time for it so that they develop mentally and socially both. Kids with higher usage of cellphones become emotionally sensitive that they do not develop emotional intelligence and aren’t able to understand what they themselves and the person Infront of them is saying. The National Commission for Protection of Child Rights (NCPCR) survey explains the impact of high limits of usage of mobiles phones on kids. It states the physical and behavioral impacts on kids. It leads to low concentration, sleep deprivation, depression, and trauma among kids. Even AIIMS Delhi Pediatric Neurology Study has explained similar phenomenon occurring among new generations. The DPDP Act sets a strict standard for children’s data safety, defining a child as anyone under the age of 18. The Information Technology (IT) Act implied more strict rules over the internet platform to regulate the content. But the application and implementation of these rules need active parental mediation and government stricter rules.

Changing Dimensions

In this fast-paced world even India has also developed a lot in corporate and industrial sector. We are heading toward a developed business. But if i say we are still staggering in some places. A recent incident which took place on October,26, 2026 and who doesn’t know it! That SBI got hacked by the AI-driven techniques. AI provides all kinds of codes to its users, it can create websites, it can be used as a weapon, it can be used for phishing attacks, and it can be used to create a code to steal someone’s data from specialized software. In fact, it has become a sugar candy for hackers and scammers. Its abilities could be considered impressive but a big danger to high profiled companies and MNC’s. Even though we know that big companies do have their own ethical hackers and high security to keep data secure from thousands of users. But in this new era can you truly say that your data is safe even with the people who invest in stock companies. What do you think would have affected SBI after they got hacked, and data from millions of users got leaked over dark web? Dark web is a dark corner of the internet and who doesn’t have information about it. It is used for illegal conduction of unlawful activities. After the data was leaked, many of the user’s bank accounts and their personal information were in extreme danger.

Many people lost faith in quality security in SBI accounts. Cybercrimes do not only attack some sectors, but every profession now needs the best security, but it still lacks the complete implementation of new laws. A Small Financial Institutions (NBFCs) in which fraudsters used a Chinese AI toolkit to hack this institution to siphon off 300 CRORES even though the institution filed 150 FIRs, but FIR wasn’t enough to give them immediate relief. They took many actions to save the accounts of users who invested their amount in this institution. They lost their 300 CRORES because all the amount was withdrawn via ATM till they could’ve done anything. It was a case of small institution so it didn’t affect anyone a lot, but SBI which is central bank of India with multiple respected and trusted users lost its reputation in many phases which might be not visible to us. Do these things need new laws or are we still working on the same rules which were made for just humans as traitors in the tech world?? Let’s check these rules are they really fitted for such types of incidents which are: CERT-In 6-Hour Rule which states that if any cyber incident occurs the company needs to report it to the government within 6 hours. Digital Personal Data Protection (DPDP) Act which states that if due to any cyber-attack the company loses the data of the users who invested in it would need to give the penalty up to 250 CRORES. None of this rule talks about that what should the company do to save itself from cyber-attack, no guidelines for safety for companies from such hackers that they should hire qualified hackers to maintain a high-level security so that the data doesn’t leak even though companies are private limited but that doesn’t mean that government cannot make rules for private company’s operation. At least it would protect the trust and data of multiple users.

Now the Government is working on bringing new laws for this new technology which really needs stricter approach so that no innocent shall suffer loss of their data, their accounts credits, personal details, and cellphone access to someone with evil intention. After seeing the current situation of AI usage in India for picture morphing through the AI tools, morphed videos and other gore content, hacking and other scams government has established the 3-Hour Crisis Takedown Rule which states that such type of content should be removed from the internet within 3 HOURS and if its case of nonconsensual intimate morphed images then the time is reduced to 2HOURS. Which is indeed a very important factor needed to be noticed because it might hurt the sentiments and disturb the other person emotionally. From my perspective, the AI toolmakers should add such restrictions to their AI tools that they do not create anything that includes anything sexual or intimate. And if someone does that then this rule made by the government is going to work very well in this scenario. The Standalone AI Act Consultation, the government is comprehensive consultation paper to draft a standalone, horizontal AI Ethics and Accountability Bill so that the company regulate its AI models according to human safety, human centric, and active regulation of digital harm. The government is looking after all the problems that are arising from the wrong usage of AI from certain people. Many other problems like scammers are defrauding people by manipulating their voices to call the users and get their personal details by faking the fact. their personal details by faking the fact. By Eliminating Algorithmic Deception and Deepfakes rule, the Government aims to enforce a permanent “techno-legal” framework for the AI toolmakers that forces platforms to develop advanced tracing to catch synthetic manipulation instantly.

Even after these many rules only some of them are implemented successfully but most of them are not followed by the companies to have a higher number of users.

Companies look after their profits most of the time. Even government employees become careless in many of the operations which need a higher amount of attention. India do need a team of people who are aware of ethical hacking, cyber laws framework, curious people who are learner of advanced technology and are honest to their work rather than misusing their ability to have these skills. If India forms an organization which only includes people who are hackers, advanced tech learners, advancement in cyber security, it will help many organizations to have better access to have a good level of cyber secured data. Even many people would get employment from this. New laws should replace the old laws now because old laws were made on the basis when there wasn’t enough people to understand cyber tech, high technology that in today’s world everything is connected with our computers, laptops and cellphone, one breach and all data lost. Even new laws need urgent development for this dynamic market of technology so that if technology develops continuously without any security, it’s going to be a very big blunder in the upcoming future. New laws are needed in this rapidly changing world. To have qualitative future of technology in India, we need some rules that directly put stricter rules over the company so that they would try to protect data of the users carefully. There should be more rules for the usage of cellphones for the kids, that if any kid uses a phone, it should be under parental control, and the parents should pay attention to the hours for which they are giving phone to their kids.

The future is going in the hands of technology and AI; we should ensure that they handle it with utmost care by the application of safety rules over those who create them, who implement them and who should follow them at any cost. Not to stop development but to do development in a way that doesn’t destroy one priceless thing of this world is the upcoming generation. In the upcoming future, we all expect that there will be a different ‘today’ we see today.

Author: SUHANI a first year student of BBA LL.B at Shobhit University.
